1. Acceptance of Terms
Welcome to Kaamkaaz (कामकाज). These Terms of Service ("Terms") govern your use of our mobile application and platform ("App" or "Service"). By downloading, installing, accessing, or using Kaamkaaz in any way, you agree to be bound by these Terms.
If you do not agree with any part of these Terms, you may not use Kaamkaaz.
Kaamkaaz is operated by Ankit (Individual Developer). These Terms constitute the entire legal agreement between you and Kaamkaaz regarding your use of the platform.
Kaamkaaz reserves the right to modify these Terms at any time. Changes are effective immediately upon posting. Continued use of the App after changes means you accept the modified Terms.
2. Eligibility & Age Requirements
Minimum Age to Use Kaamkaaz:
Workers (Daily Wage Job Seekers):
- Minimum age: 16 years old
- If 16-17 years old: Parental or guardian consent required
- If 18+ years old: Can use without consent
Recruiters (Job Posters):
- Minimum age: 18 years old
- Must be a legal adult with authority to post jobs
- May represent a company or hiring agency
General Eligibility:
- You must have a valid phone number and email address
- You must be a resident of India
- You must not be legally prohibited from using the App (e.g., not banned by court order)
- You must not have had an account previously terminated by Kaamkaaz
- You must use accurate, truthful information when registering
Children Under 13:
Kaamkaaz is NOT intended for children under 13. We do not knowingly permit users under 13 to create accounts. If discovered, the account will be immediately terminated and all data deleted.
3. Account Types & User Roles
Two User Types on Kaamkaaz:
Worker Account:
- Purpose: Search for daily wage jobs, apply for positions, showcase skills
- Responsibilities: Maintain honest profile, complete KYC verification, apply only to suitable jobs
- Privileges: Access to job listings, direct messaging with recruiters, portfolio upload
- Data Required: Full name, phone, email, location, photo, KYC documents
Recruiter Account:
- Purpose: Post daily wage job listings, find workers, manage hiring
- Responsibilities: Post legal jobs, follow labor laws, pay workers fairly, verify applicants
- Privileges: Post unlimited jobs, review applications, message workers, analytics
- Data Required: Full name, phone, email, company/organization details
Account Ownership & Responsibility:
- You are responsible for all activity on your account
- You must not share your login credentials with others
- You must keep your account information current and accurate
- You are liable for any unauthorized use of your account
- If you suspect unauthorized access, change your password immediately and contact us
4. KYC & Verification Requirements
For Workers:
To build trust and reduce fraud, workers must complete KYC (Know Your Customer) verification:
- Aadhaar Number - Government-issued unique identifier
- Live Selfie - For facial recognition and liveness verification
- Driving License (Optional) - Additional identity proof (optional)
KYC Process:
- Submit Aadhaar number and associated details
- Take a live selfie for face verification
- Upload optional documents (Driving License)
- Wait for admin verification (typically 24-48 hours)
- Once approved, you get a "KYC Verified" badge
Important:
- KYC verification is mandatory to apply for jobs
- False or fraudulent KYC information will result in permanent account termination
- Your KYC documents are stored securely and NOT shared with recruiters
- Only a "Verified" badge is visible to recruiters for privacy
For Recruiters:
Recruiters must verify their contact information and company details:
- Phone number verification (OTP confirmation)
- Email verification
- Company/Organization information (if applicable)
5. Recruiter Responsibilities
Legal Compliance:
- Post only legal, legitimate job opportunities
- Comply with all applicable labor laws, including:
- Minimum Wages Act
- Payment of Wages Act
- Occupational Safety, Health & Working Conditions Code, 2020
- Child Labor Prohibition & Regulation Act
- Do not post jobs that violate Indian law or involve illegal activities
Job Posting Standards:
- Accurate Information: Job title, location, pay rate, duration, responsibilities must be truthful
- Fair Wages: Compensation must meet or exceed applicable minimum wage laws
- Safety Standards: Ensure jobs meet occupational health and safety requirements
- No Discrimination: Do not discriminate based on caste, religion, gender, age, disability, or other protected characteristics
- Clear Terms: Be clear about work hours, conditions, equipment, hazards, and payment terms
Worker Treatment:
- Pay workers agreed wages on time
- Provide safe working conditions
- No harassment, abuse, or unfair treatment
- Respect worker privacy and dignity
- Do not ask for payment or bribes from workers
Communication Standards:
- Respond to worker inquiries promptly and professionally
- Be clear about job expectations and timelines
- Do not use offensive, abusive, or harassing language
- Respect worker preferences for contact methods (chat, call, WhatsApp)
Account Responsibilities:
- Do not post duplicate or spam job listings
- Do not impersonate other companies or individuals
- Do not share workers' contact information with third parties without consent
- Do not misuse workers' data for purposes other than hiring
6. Worker Responsibilities
Profile Integrity:
- Provide honest, accurate information in your profile
- Use a real profile photo that shows your actual appearance
- Do not misrepresent your qualifications or experience
- Update your profile if circumstances change
- Do not create multiple accounts
Job Applications:
- Apply only to jobs you are genuinely interested in and capable of performing
- Do not apply frivolously or spam job postings
- Be responsive to recruiter inquiries
- If you accept a job, commit to showing up and completing the work
Commitment to Work:
- If you accept a job, you are obligated to show up on time
- Communicate promptly if you cannot complete accepted work
- Perform work professionally and safely
- Follow recruiter instructions and workplace safety rules
- Deliver quality work as agreed
Portfolio & Documentation:
- Only upload genuine photos/videos of your own work
- Do not claim credit for work you did not perform
- Do not upload offensive, explicit, or illegal content
- Be honest about your skills and experience level
Communication Standards:
- Respond to recruiters professionally and promptly
- Do not use abusive, offensive, or harassing language
- Do not ask recruiters for money, favors, or inappropriate requests
- Respect recruiter privacy and confidentiality
KYC Compliance:
- Complete KYC verification with truthful, genuine information
- Use your real Aadhaar number and identity
- Upload genuine photos and documents
- Fraud in KYC results in permanent account termination
8. Prohibited Activities
Users agree NOT to:
Fraudulent Activities:
- Create fake accounts or profiles
- Impersonate others
- Submit false KYC information
- Misrepresent your qualifications or experience
- Use stolen or unauthorized payment methods
Harassment & Abuse:
- Harass, threaten, abuse, or intimidate other users
- Send offensive, derogatory, or discriminatory messages
- Cyberbully or engage in defamation
- Engage in sexual harassment or inappropriate behavior
- Make false accusations against other users
Spam & Abuse:
- Post spam, unsolicited commercial messages, or advertisements
- Send repeated unwanted messages
- Use bots or automated tools to interact with the platform
- Phish for information or credentials
- Post duplicate content excessively
Illegal Content & Activities:
- Post jobs involving illegal activities (theft, drugs, violence, etc.)
- Solicit illegal services or goods
- Post explicit sexual, violent, or otherwise illegal content
- Violate intellectual property rights
- Participate in human trafficking, forced labor, or child labor
Platform Misuse:
- Attempt to hack or breach Kaamkaaz systems
- Reverse engineer or decompile the app
- Interfere with platform operation
- Scrape or extract user data
- Use the platform for purposes other than job matching
Data Misuse:
- Share other users' personal information without consent
- Sell or trade user data
- Use contact information for unsolicited marketing
- Collect data without permission
Labor Law Violations:
- Post jobs that violate minimum wage laws
- Recruit child laborers (under 18 for hazardous work)
- Discriminate in hiring (caste, religion, gender, disability, age)
- Propose exploitative or dangerous working conditions
- Fail to pay agreed wages
9. Refer and Earn Program
Program Overview:
Kaamkaaz offers a Refer and Earn program that rewards users for inviting friends to join the platform.
How It Works:
- Share your unique referral link with friends
- When a friend signs up using your link, you earn rewards
- Rewards are credited to your Kaamkaaz account
- Rewards can be withdrawn or used for app features (details in separate Refer & Earn T&Cs)
Eligibility:
- Your account must be active and KYC verified
- The referred person must be a new user (first-time signup)
- The referred person must complete KYC verification
- Both parties must comply with these Terms
Restrictions:
- Do not share referral links on spam platforms or unsolicited channels
- Do not create fake accounts to generate referral rewards
- Do not offer money or incentives for signups (Kaamkaaz rewards only)
- Fraudulent referrals will be rejected and rewards forfeited
- Accounts engaging in referral fraud may be terminated
Kaamkaaz Rights:
- Kaamkaaz may modify or cancel the Refer and Earn program anytime
- Kaamkaaz may investigate suspicious referral patterns
- Kaamkaaz may forfeit rewards if fraud is suspected
- Final decision on reward eligibility rests with Kaamkaaz
10. Intellectual Property
Kaamkaaz IP:
- Kaamkaaz owns all intellectual property in the app (code, design, features)
- You have a limited license to use Kaamkaaz for personal, non-commercial purposes only
- You may not copy, modify, reverse-engineer, or create derivative works
- You may not license, sell, or distribute the app
Your Content:
- You retain ownership of content you create (profile, photos, portfolio, messages)
- By uploading content, you grant Kaamkaaz a non-exclusive license to:
- Store and display your content on the platform
- Use your content to provide the service
- Share your profile/portfolio with recruiters/workers (as appropriate)
- You may delete your content anytime by deleting your account
User Submissions:
- Do not submit content that violates others' intellectual property rights
- Do not upload copyrighted photos, videos, or materials without permission
- You are responsible for all content you upload
- Kaamkaaz may remove infringing content immediately
Trademarks:
- "Kaamkaaz" and "कामकाज" are trademarks of Ankit
- You may not use these trademarks without permission
- You may not create confusingly similar names or logos
11. Limitation of Liability
Disclaimer of Warranties:
Kaamkaaz is provided "AS-IS" and "AS-AVAILABLE" without warranties of any kind, express or implied.
- We do NOT warrant that the app will be error-free or uninterrupted
- We do NOT warrant the accuracy, reliability, or completeness of content
- We do NOT warrant that jobs will be suitable, safe, or legal
- We do NOT warrant that workers will be reliable or qualified
- We do NOT warrant that users will be trustworthy or honest
Limitation of Damages:
To the maximum extent allowed by Indian law:
- Kaamkaaz is NOT liable for any indirect, incidental, special, consequential, or punitive damages
- Kaamkaaz is NOT liable for lost profits, lost data, lost wages, or lost opportunities
- Kaamkaaz is NOT liable for disputes between workers and recruiters
- Kaamkaaz is NOT liable for non-payment of wages or unfair treatment
Maximum Liability:
Kaamkaaz's total liability for any claim shall not exceed the amount you paid to Kaamkaaz (if any) in the 12 months preceding the claim. If you have not paid Kaamkaaz, our liability is zero.
User Responsibility:
- You assume all risk related to your use of Kaamkaaz
- You are responsible for evaluating recruiter legitimacy and job suitability
- You are responsible for negotiating fair terms with the other party
- You are responsible for your own safety and well-being
12. Account Suspension & Termination
Grounds for Suspension or Termination:
Kaamkaaz may suspend or terminate your account if you:
- Violate these Terms of Service or our Privacy Policy
- Submit false or fraudulent KYC information
- Engage in harassment, abuse, or discriminatory behavior
- Post illegal jobs or solicit illegal services
- Fail to pay workers agreed wages
- Engage in spam or phishing
- Attempt to hack or breach our platform
- Violate applicable labor laws
- Have multiple accounts (prohibited)
- Engage in fraud or misrepresentation
Types of Actions:
Warning:
For minor violations, we may issue a warning and request correction.
Temporary Suspension:
For serious violations, we may suspend your account for a period (typically 7-30 days). You cannot use the app during suspension.
Permanent Termination:
For severe or repeated violations, we may permanently terminate your account and delete all data.
Account Termination Process:
- We will attempt to notify you of the reason for termination (if feasible)
- You may appeal the decision by contacting ankityo9079@gmail.com within 7 days
- We will review your appeal and provide a final decision
- If terminated, all your data will be deleted within 30 days
Important:
- Kaamkaaz has the sole discretion to suspend or terminate accounts
- We are not liable for loss of access to your account or data
- Termination due to legal violations does not affect your legal liability
13. Dispute Resolution
Disputes Between Users:
Kaamkaaz is a platform, not an employer or party to employment agreements. We do NOT mediate disputes between workers and recruiters.
If you have a dispute:
- Step 1: Try to resolve directly with the other user through the app
- Step 2: Document all communications and agreements
- Step 3: Contact the other party's phone number via WhatsApp or call
- Step 4: If unresolved, seek legal remedies outside the platform
Kaamkaaz Cannot Resolve:
- Wage and payment disputes
- Work quality disagreements
- Personal injury claims
- Harassment or discrimination incidents
- Contract breaches between users
When to Involve Legal Systems:
For serious disputes, you may file a complaint with:
- Labor Commissioner: For wage and labor law violations
- Police: For harassment, fraud, or criminal activity
- Civil Court: For contract breaches or compensation claims
- Cyber Crime Cell: For online fraud, hacking, or defamation
Complaints to Kaamkaaz:
If a user violates our Terms, you can report them via:
- In-app "Report" button on user profiles
- Email: ankityo9079@gmail.com with details and evidence
We will review reports and may suspend or terminate accounts that violate our Terms.
14. Governing Law & Jurisdiction
Applicable Law:
These Terms of Service are governed by and construed in accordance with the laws of India, including:
- Information Technology Act, 2000
- Indian Penal Code (IPC)
- Minimum Wages Act, 1948
- Payment of Wages Act, 1936
- Occupational Safety, Health & Working Conditions Code, 2020
- Digital Personal Data Protection Act, 2023
Jurisdiction & Venue:
- All disputes shall be subject to the jurisdiction of courts in India
- Both parties agree to submit to Indian legal jurisdiction
- The specific court will depend on the nature and location of the dispute
Severability:
If any provision of these Terms is found invalid or unenforceable, that provision will be severed, but the remainder of the Terms will remain in effect.
Entire Agreement:
These Terms, together with our Privacy Policy and Refer & Earn T&Cs, constitute the entire agreement regarding your use of Kaamkaaz.
